These Terms of Service ("Terms" or "Agreement") are an agreement between Rocktie.com ("Rocktie", "Rocktie.com", "we", "us", or "our") and you ("User", "Member", "you", or "your"). This Agreement governs your access to and use of the www.rocktie.com website and its related features, products, and services (collectively, the "Website" or "Services").
By accessing, registering for, or using the Website or Services, you agree to be bound by these Terms.
Accounts and Membership
You must be at least 21 years of age to access or use Rocktie.com. By accessing the Website, creating an account, or agreeing to this Agreement, you represent and warrant that you are at least 21 years of age and are legally permitted to access adult-oriented services in your jurisdiction.
If you create an account, you are responsible for maintaining the security of your login information and for activities that occur through your account. You agree to provide accurate information and to keep information that materially affects your account eligibility reasonably current.
Providing false, fraudulent, misleading, or materially inaccurate account information may result in suspension, restriction, deactivation, or termination of your account.
You must promptly notify Rocktie if you believe your account has been accessed or used without authorization.
We may suspend, restrict, disable, or terminate an account if we reasonably determine that the Member has violated these Terms, violated another Rocktie policy, engaged in fraudulent or harmful activity, created a safety risk, abused the Services, or engaged in conduct that may materially harm Rocktie or its Members.
We may also take reasonable technical measures, including blocking an email address or Internet Protocol address, to prevent repeated registration or abuse following termination.
Membership Types
A. Free Members
A Free Membership may be obtained by completing Rocktie's registration process. Free Members receive access to features designated by Rocktie for Free Members. Certain features, communications, media functions, or areas of the Website may be limited.
B. Premium Members
A registered Member may choose to purchase a Premium Membership. Premium Members receive additional features and access that are not available to Free Members. Available Premium features may change as the Website and Services are updated.
Paid memberships are associated with the specific Rocktie account for which they were purchased and may not be transferred to another account unless Rocktie expressly agrees otherwise.
Canceling automatic renewal or recurring billing does not, by itself, constitute a request to delete or terminate the Member's Rocktie account. Unless otherwise stated in the applicable purchase terms, a Member who cancels recurring billing may continue to use the paid membership through the remainder of the applicable paid membership period.
If a Member voluntarily requests termination or deletion of their Rocktie account, any active paid membership associated with that account will terminate when the account is terminated or deleted. Any remaining paid membership period will be forfeited and cannot be restored, reinstated, transferred, credited, or applied to a new or recreated account, except where otherwise required by applicable law.
C. Lifetime Premium Members
A Lifetime Premium Membership requires completion of Rocktie's registration process and purchase of an eligible Lifetime Membership plan.
For purposes of Rocktie.com, a "Lifetime Membership" provides paid membership status for a period of twenty (20) years from the applicable activation date. After the 20-year period expires, the account may revert to Free Membership status unless Rocktie provides otherwise.
Lifetime Premium Membership does not require a recurring membership payment after the initial Lifetime Membership purchase. Lifetime access remains subject to these Terms and remains available only while Rocktie.com and the applicable Services continue to operate. Lifetime Membership may end before the 20-year period if the Website or applicable Service is permanently discontinued, the Member voluntarily requests termination or deletion of the account, or the account is terminated for violation of these Terms or another applicable Rocktie policy.
If a Lifetime Premium Member voluntarily requests termination or deletion of the account, the Lifetime Premium Membership associated with that account is permanently terminated and cannot be restored, reinstated, transferred, credited, or applied to a new or recreated account, except where otherwise required by applicable law.
Rocktie will make reasonable efforts to maintain the availability of its Services but does not guarantee that any particular feature or Service will remain available for the entire 20-year period.
Club, Resort and Business Accounts
Rocktie may provide account types or features for clubs, resorts, event organizers, businesses, service providers, creators, promoters, advertisers, or other approved commercial users ("Business Accounts").
Business Accounts may use promotional or commercial features specifically provided or authorized by Rocktie. Business Accounts remain subject to these Terms and to any additional rules, eligibility requirements, advertising requirements, or agreements applicable to the particular feature or program being used.
Creating a Business Account does not grant an unrestricted right to advertise, solicit Members, send unsolicited commercial communications, or use Rocktie Member information for purposes unrelated to the authorized Services.
Affiliate Program
Rocktie may operate an affiliate or referral program that allows approved Members, businesses, websites, clubs, creators, or other partners to receive commissions for eligible referrals.
Participation in the Affiliate Program is subject to the affiliate rules, commission terms, eligibility requirements, tracking rules, payout requirements, and promotional restrictions provided by Rocktie in connection with the Affiliate Program.
Rocktie may reject, reverse, withhold, or cancel affiliate commissions associated with fraud, self-referrals where prohibited, chargebacks, refunds, spam, misleading advertising, prohibited promotional methods, manipulated tracking, or other violations of the Affiliate Program rules.
Participation in the Affiliate Program does not authorize an affiliate to send unsolicited bulk communications, impersonate Rocktie, make unauthorized claims on Rocktie's behalf, or use Rocktie trademarks except as expressly permitted.
Membership Status Changes and Validity
Rocktie accounts and membership eligibility may depend upon the Member information and account type represented to other Members.
If a Member's relationship or account status materially changes after purchasing a paid membership, including a change from a couple account to a single account or from a single account to a couple account, Rocktie reserves the right to review the account and require the Member to update, replace, or recreate the applicable profile.
Where necessary to protect Members, maintain accurate account classifications, prevent misrepresentation, or enforce Website rules, Rocktie may invalidate or terminate an existing paid membership associated with an account whose material identity or relationship information has substantially changed.
Account Deactivation and Deletion
Rocktie may provide Members with options to deactivate an account, cancel recurring billing, or request termination or deletion of an account. These actions are not necessarily the same.
Canceling automatic renewal or recurring billing does not, by itself, terminate or delete the Member's Rocktie account. Unless otherwise stated in the applicable purchase terms, a Member who cancels recurring billing may continue to use the paid membership through the remainder of the applicable paid membership period.
Deactivation generally disables access to the account but does not necessarily result in permanent deletion of the account or its information.
If a Member voluntarily requests termination or deletion of their Rocktie account, the account and associated profile information may be permanently removed. Any active paid membership associated with that account will terminate, and any remaining paid membership period will be forfeited and cannot be restored, reinstated, transferred, credited, or applied to a new or recreated account, except where otherwise required by applicable law.
A deletion request begins the process of removing the Member's account and associated information, subject to reasonable processing periods, backup retention, fraud-prevention requirements, payment records, legal obligations, dispute resolution, and other legitimate record-retention requirements.
Certain limited information may remain in backups, security records, transaction records, payment records, moderation records, or other records where retention is reasonably necessary or legally required. Retention of these records does not mean that the deleted account or membership remains active or can be restored.
User Content
Rocktie does not claim ownership of the photographs, videos, profile descriptions, comments, messages, files, or other material that you submit to the Website ("User Content").
You are responsible for ensuring that User Content you submit is accurate where appropriate, lawful, and does not violate the intellectual property, privacy, publicity, contractual, or other rights of another person.
By uploading, posting, transmitting, or otherwise making User Content available through Rocktie, you grant Rocktie a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, format, transmit, display, and distribute that User Content as reasonably necessary to operate, maintain, secure, improve, and provide the Services.
This license does not transfer ownership of your User Content to Rocktie.
We may monitor, restrict, reject, remove, disable, or delete User Content that we reasonably believe violates these Terms, another Rocktie policy, applicable law, the rights of another person, or the safety and integrity of the Website.
Marketing and Promotional Use of Content
Content that you intentionally make publicly visible on Rocktie may appear in areas of the Website that promote Rocktie features, profiles, communities, events, or other Website activity, subject to applicable privacy settings and Website functionality.
Rocktie will not treat private messages or content restricted by applicable privacy controls as publicly available promotional content merely because the content is stored through the Services.
If Rocktie wishes to use a Member's content in a separate third-party advertising campaign or promotional placement beyond the ordinary operation and promotion of the Website, such use may be subject to additional authorization, applicable privacy settings, notices, or consent where required by applicable law.
User Conduct
When using Rocktie, you agree not to engage in conduct including, but not limited to, the following:
1. Transmitting information, files, links, software, chats, communications, or other material that is unlawful, fraudulent, deliberately misleading, threatening, abusive, malicious, or intended to facilitate criminal activity.
2. Posting, requesting, promoting, arranging, or soliciting prostitution, commercial sexual services, sexual activity in exchange for money or other valuable consideration where prohibited by law, or other illegal transactions.
3. Posting, possessing, requesting, distributing, promoting, or facilitating any sexual or exploitative material involving minors.
4. Posting, promoting, facilitating, or assisting human trafficking, sexual exploitation, coercion, or forced sexual activity.
5. Posting or distributing intimate photographs, videos, recordings, or sexually explicit material depicting another person without that person's consent.
6. Creating or distributing manipulated, digitally altered, or artificially generated sexually explicit material depicting an identifiable person without appropriate authorization or consent.
7. Posting products, services, substances, transactions, or activities whose use or sale is prohibited by applicable law.
8. Publishing another person's private or personally identifiable information, photographs, video recordings, audio recordings, contact information, or other sensitive information without authorization where authorization is required.
9. Harassing, threatening, stalking, intimidating, blackmailing, extorting, or deliberately targeting another Member for abuse.
10. Impersonating another person, creating a materially false identity, misrepresenting the people represented by an account, or intentionally portraying yourself as a different person or account type in a manner designed to deceive other Members.
11. Using Member information, email addresses, contact information, photographs, profiles, or other information obtained through Rocktie for unauthorized commercial solicitation, bulk advertising, spam, data collection, or resale.
12. Using automated systems, bots, scripts, scraping tools, crawlers, or other methods to collect Member information or interact with the Services without Rocktie's authorization.
13. Attempting to circumvent account restrictions, moderation controls, membership limitations, security measures, payment controls, communication restrictions, blocking features, or other Website protections.
14. Intentionally interfering with the normal operation, security, integrity, or availability of the Website.
15. Using Rocktie for unauthorized commercial activity except through Business Account features, advertising services, affiliate programs, or other promotional activities specifically authorized by Rocktie.
External Website and App Mentions
Members may not use Rocktie chats, private messages, profiles, comments, or other communication features to share, promote, solicit, or direct Members to unauthorized external websites, applications, social media platforms, messaging services, competing services, or off-site communication methods.
Typing, disguising, coding, or otherwise communicating the name, username, address, handle, or identifying information of a prohibited external website, app, social platform, or messaging service may result in moderation action or a strike against the account.
Repeated violations may result in temporary restrictions, suspension of communication privileges, or permanent removal of access to certain Services.
This restriction applies to Free and paid Members.
This restriction does not prohibit links, promotional activities, or external references that Rocktie expressly provides, approves, or authorizes through an Affiliate Program, Business Account feature, advertising arrangement, event feature, cross-promotion arrangement, or another authorized Website function.
Member Communications
Rocktie may provide chatrooms, direct messages, comments, replies, profile communications, or other Member-to-Member communication features.
Access to individual communication features may depend on membership type, account status, verification status, moderation status, Member preferences, blocking settings, or other eligibility requirements.
Rocktie may impose reasonable communication limits, spam-prevention controls, moderation restrictions, strikes, temporary suspensions, or other measures intended to protect Members and maintain the integrity of the Services.
Purchasing a paid membership does not exempt a Member from communication restrictions, moderation rules, Member blocking decisions, safety controls, or these Terms.
Adult Content
Rocktie is intended for adults and may contain sexually explicit, mature, or adult-oriented content.
Individuals under 21 years of age may not access or use the Website.
You are responsible for determining whether accessing adult-oriented content is lawful in your jurisdiction.
If Rocktie becomes aware that an account is being used by a person under the age of 21, Rocktie may immediately suspend access and begin the process of terminating or removing the account.
All persons depicted in sexually explicit User Content must be adults who were at least 18 years old when the content was created, and the Member submitting that content must have the legal right and appropriate authorization to upload or distribute it.
Billing and Payments
You agree to pay all fees associated with purchases you voluntarily make through Rocktie according to the prices and payment terms displayed at the time of purchase.
Available payment methods may vary and may include third-party payment processors or alternative payment methods.
When a payment is processed by a third-party payment provider, that transaction may also be subject to the provider's own terms, privacy practices, network rules, processing requirements, and transaction limitations.
If a membership or other Service is expressly identified as recurring or automatically renewing at the time of purchase, you authorize applicable recurring charges according to the billing interval and cancellation terms presented with that purchase.
A membership that is identified as non-recurring or Lifetime will not automatically renew unless the purchase terms expressly state otherwise.
Rocktie reserves the right to change its products, membership plans, available features, and prices. A price change will not retroactively change the completed purchase price of a transaction already paid unless required by law, agreed to by the Member, or necessary to correct an obvious billing error.
Rocktie may refuse, cancel, review, or reverse a transaction where reasonably necessary due to suspected fraud, payment failure, duplicate transactions, processing errors, chargebacks, prohibited activity, legal requirements, or violations of these Terms.
Membership activation may be delayed while a payment is being confirmed or reviewed.
Alternative and Cryptocurrency Payments
Rocktie may make certain alternative payment methods or cryptocurrency payment options available for eligible purchases.
The Member is responsible for following the payment instructions shown for the selected payment method, including sending payment to the correct account, wallet, address, currency, token, and network where applicable.
Cryptocurrency transfers may be irreversible. Rocktie is not responsible for cryptocurrency or digital assets sent to an incorrect wallet address, through an unsupported blockchain network, using an unsupported asset, or in an incorrect amount when the error results from information entered or selected by the sender contrary to the payment instructions provided by Rocktie.
Alternative payment and cryptocurrency purchases may require manual confirmation before membership status is updated.
Refunds and Chargebacks
Refund eligibility is governed by Rocktie's Refund Policy and any applicable law.
Initiating a fraudulent, abusive, or intentionally misleading payment dispute or chargeback may result in suspension or termination of the associated account.
Nothing in these Terms limits any refund, cancellation, dispute, or consumer right that cannot legally be waived.
Accuracy of Information
Rocktie attempts to provide accurate information, but the Website may occasionally contain typographical errors, inaccuracies, outdated information, or omissions involving features, membership plans, pricing, availability, promotions, or other content.
We reserve the right to correct errors, update information, modify Website content, and correct or cancel transactions affected by an obvious error where permitted by law.
We are not obligated to update every reference or description immediately whenever a Website feature changes unless required by applicable law.
Backups and Data Availability
Rocktie may perform backups of Website systems and data as part of normal operations. However, backups are maintained primarily for operational and disaster-recovery purposes and are not guaranteed to preserve or restore every item of User Content.
Members should retain their own copies of important photographs, videos, messages, files, and other content.
Links to Other Websites
The Website may contain authorized links to third-party websites or services.
A link does not necessarily constitute Rocktie's endorsement, sponsorship, approval, or guarantee of the third party unless expressly stated.
Rocktie does not control third-party websites and is not responsible for their content, availability, privacy practices, security, products, transactions, or services.
You should review the terms and privacy practices of any third-party service you choose to access.
Advertisements and Third-Party Promotions
Rocktie may display advertisements, sponsored content, business listings, event promotions, affiliate promotions, or other third-party offers.
Unless Rocktie expressly states otherwise, transactions, communications, representations, warranties, and agreements between a Member and a third-party advertiser or business are solely between those parties.
Rocktie is not responsible for the independent acts, products, representations, or services of a third-party advertiser merely because that advertiser appears on the Website.
Prohibited Uses
In addition to other restrictions in this Agreement, you may not use the Website or Services:
(a) for an unlawful purpose;
(b) to solicit, encourage, facilitate, or participate in unlawful acts;
(c) to violate applicable international, federal, state, or local laws or regulations;
(d) to infringe or violate Rocktie's intellectual property rights or the intellectual property rights of another person;
(e) to harass, abuse, threaten, intimidate, exploit, or unlawfully discriminate against another person;
(f) to intentionally submit fraudulent or materially misleading information;
(g) to upload viruses, malicious code, destructive software, or material intended to interfere with the Website or another system;
(h) to collect, scrape, harvest, or track personal information about Members without authorization;
(i) to spam, phish, pharm, pretext, scrape, crawl, or conduct unauthorized automated activity;
(j) to distribute unlawful sexually explicit material, non-consensual intimate material, exploitative material, or material involving minors;
(k) to interfere with, disable, bypass, defeat, or circumvent security, membership, moderation, payment, privacy, blocking, or access-control features; or
(l) to use the Website in a manner that materially interferes with another Member's reasonable use of the Services.
Rocktie may restrict or terminate access to the Services for violating these prohibited-use rules.
Safety and Member Interactions
Rocktie provides an online platform through which adults may communicate and interact. Rocktie does not guarantee the identity, intentions, honesty, background, health status, relationship status, or conduct of any Member.
You are responsible for exercising appropriate judgment when communicating with or meeting another Member.
Any decision to communicate off-site, exchange personal information, meet in person, participate in an event, or engage in any activity with another Member is made at your own discretion and risk.
Rocktie is not responsible for private agreements, encounters, communications, or conduct occurring between Members outside the Services.
Intellectual Property Rights
This Agreement does not transfer to you any ownership interest in Rocktie's intellectual property.
All rights, title, and interest in Rocktie's proprietary software, Website design, trademarks, service marks, logos, graphics, databases, branding, and other protected materials remain with Rocktie or the applicable licensors.
Third-party trademarks, logos, graphics, or materials remain the property of their respective owners.
Your use of the Website does not grant you a license to reproduce, distribute, copy, modify, or commercially use Rocktie intellectual property except where Rocktie expressly authorizes such use.
Copyright and Rights of Others
You may not upload or distribute content that you do not have the legal right to use.
Rocktie may remove or restrict content in response to a valid intellectual property complaint or where Rocktie reasonably believes that content infringes another person's rights.
Members who repeatedly infringe intellectual property rights may have their accounts restricted or terminated.
Disclaimer of Warranty
To the fullest extent permitted by applicable law, your use of the Website and Services is at your own risk.
The Website and Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Rocktie does not warrant that the Website will always be uninterrupted, available, secure, error-free, or free from harmful components, or that every defect will be corrected.
Rocktie does not guarantee the accuracy, reliability, authenticity, identity, conduct, representations, or User Content of Members or third parties.
You understand that downloading, accessing, sending, receiving, or relying upon material through the Services is done at your own discretion and risk.
Limitation of Liability
To the fullest extent permitted by applicable law, Rocktie.com and its affiliates, officers, directors, employees, agents, suppliers, and licensors will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including loss of profits, revenue, data, goodwill, use, business opportunities, or anticipated savings, arising from or related to your use of the Website or Services.
To the maximum extent permitted by applicable law, the aggregate liability of Rocktie.com and its affiliates, officers, employees, agents, suppliers, and licensors relating to the Services will be limited to the greater of one U.S. dollar ($1.00) or the amount actually paid by you to Rocktie for the applicable Services during the one-month period immediately preceding the event giving rise to the claim.
These limitations apply regardless of the legal theory asserted and even if Rocktie has been advised of the possibility of such damages, except where applicable law does not permit the limitation or exclusion.
Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Rocktie.com and its affiliates, directors, officers, employees, agents, and representatives from liabilities, losses, damages, claims, or reasonable costs, including attorneys' fees, arising from third-party claims relating to your User Content, your violation of these Terms, your infringement of another person's rights, your unlawful use of the Services, or your willful misconduct.
Enforcement and Moderation
Rocktie may use automated systems, human moderation, Member reports, technical controls, account restrictions, warnings, strikes, temporary suspensions, feature restrictions, or permanent account termination to enforce Website rules.
Rocktie is not required to use the same enforcement action for every violation. The action taken may depend upon the nature, frequency, severity, context, account history, safety implications, and other relevant circumstances of the violation.
Rocktie may take immediate action without prior warning where reasonably necessary to protect Members, prevent fraud or abuse, comply with legal obligations, or protect the Website and its Services.
Severability
If any provision or portion of this Agreement is determined by a court of competent jurisdiction to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in full force and effect.
Dispute Resolution and Governing Law
The formation, interpretation, and performance of this Agreement and disputes arising from or relating to it will be governed by the laws of the State of Texas and applicable federal laws of the United States, without regard to conflict-of-law principles.
To the extent permitted by applicable law, the state and federal courts located in Texas will have jurisdiction over disputes relating to this Agreement, and you consent to the personal jurisdiction of those courts.
To the extent permitted by applicable law, you and Rocktie waive the right to a jury trial in proceedings arising from or relating to this Agreement.
The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement.
Assignment
You may not assign, resell, sublicense, transfer, or delegate your rights or obligations under this Agreement without Rocktie's prior written consent.
Rocktie may assign or transfer its rights or obligations under this Agreement in connection with a merger, acquisition, corporate reorganization, sale of assets, transfer of the Website, or similar business transaction.
Changes to the Services
Rocktie may add, modify, restrict, replace, or discontinue Website features or Services from time to time.
A paid membership provides access to the membership level and Services generally offered for that membership but does not guarantee the permanent availability of every individual feature, design element, chatroom, media function, promotional feature, or communication tool.
Changes and Amendments to These Terms
We reserve the right to modify these Terms or policies relating to the Website and Services from time to time.
When material changes are made, Rocktie may provide notice through the Website, account interface, email, or another reasonable method where appropriate or required.
The updated version will become effective on the date stated in the revised Terms unless otherwise indicated.
Your continued use of the Website after the effective date of updated Terms constitutes acceptance of the revised Terms to the extent permitted by applicable law.
Acceptance of These Terms
By creating an account, accessing the Website, purchasing a membership, or using the Services, you acknowledge that you have read and agree to these Terms.
If you do not agree to these Terms, you may not access or use Rocktie.com or its Services.
